Defamation

Information overload, the development of social networking sites and the evolution of communication between people which is steadily replacing personal contact by a digital one, led to a dramatic increase in defamation suits which in its turn gave an impetus to the development of judicial proceedings in the field of law.

Hiding behind the computer screen and pressing the keyboard buttons, many came to realize that it is much easier to communicate this way rather than look in the eyes of a living person.

According to the Israeli law, libel is a statement that is an insult to human dignity (a person or a group of people or an organization) and tarnishes their reputation.

Defamation law defends a person’s honour and reputation by means of imposing a ban on making any statements public which could insult a person or cause a contempt for him/her. 

 

Defamation suits are filed not only in standard situations, but also in cases of false sanctions imposed on an individual’s bank account. A bank account’s owner’s reputation is tarnished in the eyes of bank employees; thus such actions taken by a bank are qualified by court as defamation.

 

The compensation an individual is eligible for is 75,000 shekels. This amount of compensation can be obtained with no need for proving an actual damage (mental or physical). If a plaintiff manages to prove that the actions taken against him were intentional, the compensation can amount to 140,000 shekels. 

 

Apart from civil liability one is subjected to a criminal one as well.
